Your Data Rights
This page explains the rights Luhono account holders have over their personal information and how to use them. It works alongside our Privacy Policy. Wherever you live, we give you the same core rights over your information. If you are in the EU, the EEA, Switzerland, or California, the law gives you some additional rights, and we describe those below.
Because we design Luhono to be platform-blind and, where possible, to encrypt your content with keys only you hold, there is often nothing readable for us to access, correct, or hand over. Where we do hold information about you, the rights below apply and we will always tell you honestly what we can and cannot produce.
The rights everyone has
No matter where you live, you can ask us to:
- Tell you what personal information we hold about you, and give you a copy of it.
- Correct information that is wrong or out of date.
- Delete your information and close your account. Where we can, we build this into the product so you can export or delete your data yourself, without asking.
- Withdraw a permission you gave us earlier. Any access we need to improve the product will be requested from you as an opt-in and you can take that permission back at any time.
- Object to a particular use of your information, or ask us to limit it.
We will not treat Users differently, charge more, or give a lesser experience if they choose to exercise any of these rights.
If you are in the EU, the EEA, or Switzerland
In addition to the rights listed above, if you are in the European Union, the European Economic Area, or Switzerland, the General Data Protection Regulation (GDPR) and the Swiss Federal Act on Data Protection (FADP) also give you the right to:
- Restriction: ask us to pause our use of your information while a concern is worked out.
- Portability: receive the information you gave us in a portable, machine-readable format, and have it sent to another provider where that is technically feasible.
- Not be subject to a decision based solely on automated processing that produces legal or similarly significant effects for you.
- Lodge a complaint with your local data protection authority. We would rather you came to us first at support@luhono.com so we can put it right, but you do not have to.
We only process your personal information when we have a lawful basis to do so: because you have given consent, it is necessary to provide a service you asked for, we have a legal obligation, or because we have a legitimate interest that does not override your rights. We will tell you which basis applies if you ask.
If you are in California
In addition to the rights listed above, if you are a California resident, the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), also gives you the right to:
- Opt out of the sale or sharing of your information. Note that Luhono does not sell your personal information, and we do not share it for cross-context behavioral advertising — so while it is your right, there is nothing to opt out of.
- Limit our use of sensitive personal information only for the limited purposes the law allows.
- A right to know: when you ask what we hold about you, you can also ask for the categories and specific pieces of information, where we got it, why we collected it, who we shared it with, and a right to correct inaccuracies.
- Non-discrimination: you have the right not to be treated differently for exercising any of these rights. This is a promise to every Luhono user, regardless of geography.
California’s “Shine the Light” law also lets you ask whether we shared personal information with third parties for their own direct marketing. Note that there is nothing to disclose as Luhono does not share your data with third parties for marketing purposes.
How to use these rights
At the time of publishing, the most direct way to exercise any right is to email us at support@luhono.com. The ability for Users to export and delete directly from their instance of Luhono is on our product roadmap.
When you contact us, we will:
- Take reasonable steps to confirm it is really you before we act, so that no one else can request your information.
- Respond within the time the law requires — typically within one month for GDPR and FADP requests, and within 45 days for CCPA and CPRA requests. Luhono will inform you in writing if more time is needed.
- Do it free of charge in ordinary cases.
You may use an authorized agent to make a request for you, with proof that you had granted them permission to do so.
If we cannot fully honor a request, we will explain why and you can always ask us to reconsider.
You can also complain to your data protection authority: in the EU, EEA, or Switzerland, your local authority; in California, the California Privacy Protection Agency or the California Attorney General.
Because your content is encrypted, where possible, with keys only you hold, there is often nothing readable for us to produce — and we would rather tell you that plainly than pretend otherwise.
